Terms of Service Agreement
The following terms and conditions (“Conditions”) apply to the Modern Contractor Solutions Expo 2020 (“Expo”) hosted by Highlands Publications (“HP”). By registering for the Expo, you accept these Conditions, which shall govern your attendance at and participation in the Expo.
REGISTRATION AND ADMISSION
HP reserves the right to accept or decline any registration to attend the Expo. Attendees are expected to be respectful to other attendees, HP staff members, exhibitors, and vendors. Harassment and other misconduct will not be tolerated; violations will be addressed promptly. HP reserves the right to prohibit participation or to remove any individual, whether an attendee, exhibitor, or vendor, whose conduct is not in keeping with the character and purpose of the Expo or whose conduct is otherwise objectionable, disorderly, disruptive, or in violation of any laws as determined by HP in its sole and complete discretion.
VIRTUAL EXPO PLATFORM
As part of your participation in the virtual Expo, you may choose to participate in activities that will result in sharing your personal information and other information about your participation in the Expo with other attendees, HP staff members, exhibitors, and vendors. Such information may include content you share while using chat or video functionality. HP may also monitor and track your activity and participation in the virtual Expo platform in connection with its administration and management of the Expo.
PRIVACY AND USE OF YOUR PERSONAL INFORMATION
HP may use your personal information to contact you about the Expo and send you marketing emails related to HP publications, products, and services. You may opt-out of receiving these emails by clicking on the opt-out/unsubscribe link located at the bottom of any of the emails and following the instructions.
During the Expo, you may virtually enter exhibitor booths. If you choose to enter an exhibitor’s booth, we may share your personal information (such as your name, email address, telephone number, your company’s name and your role with your company, your country of residence) and/or information about your participation and activities during the Expo with that exhibitor who may contact you or send you content regarding its products and services.

APPEARANCE RELEASE
By registering for and participating in the Expo, you grant permission to HP and its contractors to record, photograph, or otherwise capture your likeness, appearance, and name, and to edit, copy, distribute, display, publish, make derivatives of, and otherwise use such materials, in whole or in part, for any purpose, including but not limited to marketing and promotional purposes. You understand that HP will be the sole owner of the results and proceeds of these recordings, images, and materials. You waive any right to inspect or approve the use of such materials or of any written copy related to such materials. You also waive any right to royalties or other compensation arising from or related to the use of such materials. By registering for and participating in the Expo, you agree to release, defend, indemnify, and hold harmless HP from and against any claims, damages, or liability of any kind or nature arising from or related to the use of these recordings, images, and materials, including but not limited to claims of defamation, invasion of privacy, or rights of publicity.
CANCELLATION POLICY
HP reserves the right to cancel or reschedule the Expo at any time. If HP determines that it must cancel the Expo, HP will promptly notify you. You are solely responsible for any incurred costs, expenses, and/or fees related to the cancelled or rescheduled Expo.
UNAUTHORIZED COMMERCIAL SOLICITATION
Unauthorized commercial solicitation at the Expo is prohibited. Any non-exhibiting supplier, vendor, or attendee observed distributing information or soliciting business at the Expo will be asked to exit the virtual Expo.
INDENIFICATION OF HP; LIMITATION OF LIABILITY; RELEASE OF CLAIMS
As a condition of your participation in the Expo, you agree to indemnify and hold harmless HP and its parent companies, affiliates, subsidiaries, and its and their contractors, officers, employees, agents, directors, and shareholders from and against any and all claims and liabilities of whatever kind or nature in law, equity, or otherwise, arising from your actions, omissions, fault, or negligence, which result in damage to HP or to any third party, including personal injury to or death of any person and/or damage to or loss of use of property.
IN NO EVENT WILL HP BE LIABLE FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES ARISING FROM YOUR PARTICIPATION IN THE EXPO, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY. THIS LIMITATION WILL APPLY EVEN IF HP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
As a condition of your participation in the Expo, you agree to fully, finally, and forever release, waive, discharge, and covenant not to sue, demand, claim, or proceed to collect from HP and its affiliates, subsidiaries, and its and their contractors, officers, employees, agents, directors, and shareholders, any and all present and future claims, demands, actions, attorney’s fees, causes of action, suits, damages, losses, and expenses, of any kind or nature, whether known or unknown, arising from or relating to your participation in the Expo.
GENERAL
If a court finds any provision of these Conditions unenforceable as written, then the court shall interpret, modify, or strike all or a portion of that provision so as to effect as much of the parties’ agreement and intent as is legally possible. Regardless of the enforceability of any particular provision, the other portions of these Conditions shall continue in full force and effect. Those provisions of these Conditions that by their nature are intended to survive termination or expiration of the Conditions shall so survive. These Conditions are governed by and will be construed in accordance with the laws of the State of Alabama without regard to its conflict of law principles. You expressly consent to the personal jurisdiction and venue of the state and federal courts located in Jefferson County, Alabama.
